TERMS AND CONDITIONS OF USE FOR AJAX DOWNS CASINO

1. ACKNOWLEDGMENT

   By accessing or utilizing any services, facilities, or amenities provided by Ajax Downs Casino (the "Casino"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions of Use ("Terms").

2. DEFINITIONS

   In these Terms, the following definitions shall apply:

• "Authorized Personnel" means employees, agents, contractors, or officers of the Casino or its affiliates;
• "Casino Operations" includes but is not limited to slot machines, electronic table games, live quarter horse racing, simulcast wagering on other tracks, and any associated amenities;
• "Games" refers to any casino game played for real money, including slots, video lottery terminals (VLTs), or electronic table games.

3. AGE AND IDENTITY REQUIREMENTS

   You must be at least 19 years of age to access the Casino's facilities or participate in its operations. You agree to provide proof of your identity and age upon request by Authorized Personnel.

4. GAMBLING RESPONSIBILITY

   It is your responsibility to gamble responsibly, set personal limits, and not engage in excessive gaming activities that may negatively impact you or others. The Casino reserves the right to restrict access to any individual deemed a problem gambler by our staff or as defined by provincial law.

5. CASINO OPERATIONS AND FACILITIES USE

• Access to certain areas of the casino, including VIP rooms or private gaming areas, may be restricted or denied at any time.
• Use of electronic devices (including mobile phones and cameras) is prohibited in designated gaming areas.
• The Casino reserves the right to restrict or deny access to its facilities for reasons related to security, safety, or operational considerations.

6. TRANSACTIONS AND WAGERING

   All wagers must be made lawfully and within your means. You are responsible for ensuring that all transactions (including deposits, withdrawals, and winnings) are conducted in a secure manner.

7. LOSS LIMITS AND SELF-EXCLUSION

• Voluntary self-exclusion programs may be used to exclude yourself from the casino for set periods.
• Loss limits can be voluntarily set by you at any time with assistance from our staff; however, we encourage responsible gaming practices and advise against excessive betting or losing streaks.

8. INTELLECTUAL PROPERTY AND TRADEMARKS

   You acknowledge that all intellectual property rights (including trademarks) in the Casino's branding, logos, imagery, and game content are owned exclusively by Ajax Downs Casino or its affiliates. Any unauthorized use of these marks will be considered an infringement upon our proprietary rights.

9. ASSUMPTION OF RISK

• By participating in casino operations, you acknowledge that there is inherent risk associated with gaming activities.
• The Casino disclaims any liability for losses sustained as a result of your participation in games or casino operations.

10. COMPLIANCE WITH LAW AND REGULATIONS

a) Ontario Gaming Control Act, 1992;b) Ontario Racing Commission Rules and Regulations;c) All relevant federal statutes and regulations.

11. GOVERNING LAW AND JURISDICTION

    These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario. Any disputes arising from or related to these Terms will be resolved through binding arbitration administered by a reputable, third-party dispute resolution service, as per applicable provincial law.

12. AMENDMENTS AND INTERPRETATION

• The Casino reserves the right to modify or update any terms and conditions at its sole discretion.
• These Terms shall supersede all prior understandings regarding your use of our facilities and operations.

13. ENTIRE AGREEMENT

    These Terms constitute the entire agreement between you and Ajax Downs Casino with respect to the subject matter hereof, and supersedes all other oral or written agreements.

14. ACCEPTANCE OF TERMS

    By accessing any casino operation or facility, you signify that you have read, understood, and agree to be bound by these Terms.
